ESTATE SALES AND PROBATE

Estate Sales & Probate Real Estate Services

Professional Guidance During a Difficult Transition

Selling a home after the loss of a loved one can be an emotional and complicated experience. Along with grieving, families and estate trustees may face important decisions about the property, personal belongings, legal requirements, finances and the timing of the sale.

With 20 years of real estate experience, I help estate trustees, executors and families navigate the sale of estate homes and condominiums throughout Mississauga, Oakville and Burlington.

My approach is discreet, patient and professional. I understand that an estate sale is about more than real estate. It involves a home filled with memories, family considerations and a series of decisions that may be unfamiliar to those responsible for managing the estate.

I'll help you understand the real estate process, plan the steps involved and coordinate the transition from preparing the property for sale through to closing.

My goal is to make the process as organized and stress-free as possible, while respecting the wishes of the family and the responsibilities of the estate trustee.

Experienced guidance.

Personal attention.

A trusted resource when you need one most.

Selling an Estate Home in Ontario: The Steps Involved

Understanding the process can make a difficult situation easier to manage. Although every estate is different, the following steps provide a useful starting point.

The first step is to determine who has the legal authority to manage the estate and deal with the property.

Locate the will, if one exists, and identify the named estate trustee. An Ontario estates lawyer can advise whether probate or another court appointment is required and confirm what authority is needed to sell the property.

The legal requirements depend on the circumstances, including how the property is owned and whether a court certificate is required.

An estates lawyer can explain the estate trustee's responsibilities, determine the appropriate legal process and advise on the requirements for selling and transferring the property.

This is particularly important before entering into an agreement to sell. In Ontario, a Certificate of Appointment of Estate Trustee or Small Estate Certificate should be obtained before anyone enters into an Agreement of Purchase and Sale when the deceased's real property must be sold, according to the province's probate guidance.

I'll work alongside the appropriate legal professionals on the real estate side of the transaction.

Understanding the property's potential market value helps the estate trustee make informed decisions.

I'll review comparable sales, competing listings, the property's condition and relevant local market conditions to provide a professional real estate assessment.

If a separate date-of-death valuation is needed for estate administration or tax purposes, I'll discuss the appropriate valuation requirements and help identify the suitable professional or service.

If the property is vacant, it's important to address security, insurance and ongoing maintenance.

Depending on the circumstances, this may include:

  • Confirming that the insurer has been informed and that appropriate coverage is in place
  • Checking doors, windows and access points
  • Arranging regular property inspections
  • Maintaining heating, plumbing and other essential systems as appropriate
  • Managing lawn care, snow removal and other exterior maintenance
  • Redirecting mail and managing deliveries
  • Keeping records of expenses paid by the estate

Insurance requirements can change when a property becomes vacant, so the estate trustee should confirm the arrangements directly with the insurer.

Clearing a longtime family home can be one of the most emotional parts of the process.

Before belongings are removed, the estate trustee should follow the will, obtain appropriate guidance where needed and ensure that personal property is handled in accordance with the estate's obligations.

Depending on the situation, I can help connect you with services for:

  • Sorting and organizing belongings
  • Distributing items to family members
  • Estate sales and auctions
  • Donations
  • Furniture removal
  • Junk removal
  • Cleaning and property preparation

There's no need to tackle everything at once. A clear plan and the right support can make the process more manageable.

Not every estate property needs extensive renovations.

I'll help identify the repairs, cleaning, decluttering and presentation improvements that may be worthwhile before listing. The goal is to prepare the home appropriately without spending unnecessarily from estate funds.

Where required, I can help connect the estate trustee with reliable contractors, cleaners, landscapers and other service providers.

Once the property is ready, we'll discuss an appropriate asking price and a marketing strategy tailored to the home.

This may include professional photography, a carefully prepared listing, online exposure, showing arrangements and other marketing activities appropriate to the property.

I'll explain the strategy, review market feedback with you and keep the estate trustee informed throughout the listing period.

When an offer is received, I'll help the estate trustee evaluate the purchase price alongside other important terms, including conditions, deposit, closing date and the buyer's proposed arrangements.

I'll explain the real estate considerations and negotiate with the estate's objectives in mind. Any questions about legal authority, beneficiary consent or the estate trustee's legal duties should be referred to the estates lawyer.

After an agreement is accepted, there are still important details to manage.

I'll coordinate the real estate process with the estate trustee, buyer's agent and appropriate legal professionals. This includes keeping track of key dates, helping organize property access and working toward a smooth closing.

The estate lawyer will handle the legal transfer of title and advise on the treatment of the sale proceeds.

Once closing is complete, the property can be transferred according to the agreement, and the estate trustee can continue with the remaining estate administration responsibilities.

My role is to make the real estate portion of that transition as organized and straightforward as possible.

You don't have to manage every detail alone.

I'll help you understand what comes next and connect you with the appropriate services along the way.

Estate Planning Tips: Preparing for the Future

Estate planning is primarily a legal and financial matter, but there are practical steps homeowners can consider today to make the eventual transition easier for their families.

01

Keep Your Will Up to Date

A current will can help communicate your wishes and identify the person you want to manage your estate. An estates lawyer can help ensure your will reflects your circumstances and meets applicable legal requirements.

02

Choose an Appropriate Estate Trustee

Consider who has the time, ability and willingness to manage your affairs. Discuss the responsibility with your chosen person in advance, and ask a lawyer about naming an alternate.

03

Make Important Documents Easy to Find

Let your trusted representative know where important documents are stored. These may include your will, property information, insurance policies, mortgage details and contact information for your professional advisers.

Keep sensitive information secure rather than leaving passwords or financial account details in an unsecured file.

04

Review How Your Property Is Owned

If you own a home or condominium jointly with someone else, ask a lawyer to explain how the ownership arrangement affects what happens when one owner dies. Joint ownership does not always have the same legal consequences, and the details matter.

05

Discuss Your Real Estate Wishes With Family

If you anticipate selling a home, moving into a condominium or eventually downsizing, an early conversation can help family members understand your preferences.

You can discuss the practical considerations without having to make an immediate decision.

06

Consider the Practicalities of Maintaining Your Home

Think about who would look after the property if you were no longer able to do so, or if it became vacant after your death. Insurance, security, maintenance and access arrangements are worth considering in advance.

07

Organize Information About Personal Belongings

You may wish to identify sentimental possessions, family heirlooms and items you hope will go to particular people. Discuss your wishes with your lawyer so they can advise how best to document them.

08

Understand Potential Costs and Tax Considerations

Ask your lawyer and accountant about potential estate administration costs, tax obligations, property expenses and the financial implications of selling real estate.

Planning ahead can help your family understand the responsibilities involved rather than having to discover everything during a difficult period.
