Conditions in an Offer

There can be any number of conditions in the Agreement to Purchase so long as both parties agree to the terms of each condition. The two most common conditions included in an Agreement of Purchase & Sale these days include;

  • arranging Mortgage financing satisfactory to the Buyer in their sole and absolute discretion
  • performing a Home Inspection and obtaining a report that’s satisfactory to the Buyer in their sole and absolute discretion  
Each condition must stipulate/identify
  • what activity must be completed
  • who is to complete the activity
  • number of days to complete/fulfill the activity
  • what happens if the condition is not completed/fulfilled by the deadline date  
Other conditions that may be included in an Agreement of Purchase & Sale could include; 
  • the Buyer being able to sell their current home
  • the Buyer being able to get approval from the City to demolish the existing home and build a custom home
  • the Buyer being able to have their lawyer review the offer
  • the Buyer receiving an up to date survey of the property
